Introduction (Service Coverage):
  1. Mainland students who intend to take a higher education program at a higher institute in Macao are required to apply for "Special Authorization to Stay" (aka "Authorization to Stay - student type") and renewal of the Authorization according to Terms 1-4, Article 8 of Law No. 4/2003 in order to legally stay in Macao for study.
  2. Students from other countries/regions and studying at a higher institute in Macao may apply for "Special Authorization to Stay" (aka "Authorization to Stay - student type") and renewal of the Authorization according to Terms 1-4, Article 8 of Law No. 4/2003 if the limit of stay granted in the original "Authorization to Stay" is not long enough for them to legally stay in Macao for study.

II. Application Eligibility

Application Approach:
  1. Mainland Students:
    Mainland students holding a "P.R.C. Permit for Travelling to and from Hong Kong and Macao" are required to apply for "Authorization to stay - student type" as soon as they enter Macao with "Type D – Stay" endorsement and within the limit of stay granted upon their first entry (a maximum of 90 days). [For details, please see Point I in "Remark"]
  2. Students from other countries/regions:
    They should make the application in person 20 days before the expiry of the "Authorization to Stay".

  1. A completed application form for "Special Authorization to Stay";
  2. Documents certifying enrollment at a higher institute in Macao and stating the program duration (e.g. school testimonial);
  3. A recent 1.5-inch, full-face, no-hat, white-background, coloured or black-and-white photo of the interested person;
  4. Valid passport/travel document of the interested person:
    (1) Students from the Mainland China – A copy of a valid "P.R.C. Permit for Travelling to and from Hong Kong and Macao" and "Type D – Stay" endorsement (bio data page and inside pages with exit-entry stamps and the "endorsement" for book style "P.R.C. Permit for Travelling to and from Hong Kong and Macao" users), and the copy of Arrival Card for the latest entry to Macao;
    (2) Students from other countries/regions – A copy of a valid passport/travel document (bio data page only), and the Arrival Card for the latest entry to Macao.
II. Follow-up procedure:
  1. After submitting all the necessary documents and receiving a "receipt", the interested person (or institute representative) is required to come for inquiry of the application result on the date specified on the "receipt". For inquiry of the progress of the application, the interested person may refer to 'Inquiry System of Progress of Application for "Special Authorization to Stay" for Non-resident Students' on our website. He/she can come for the follow-up procedure when the result is out.
  2. Individual application:
    (1) The interested person is required to bring along the following documents for inquiry of the application result:
    A. Application acceptance receipt
    B. Valid passport/travel document or "P.R.C. Permit for Travelling to and from Hong Kong and Macao" (together with "Type D – Stay" endorsement)
    (2) If the application is approved, the interest person will be issued "Slip of Authorization to Stay - student type", and sign to acknowledge the notification letter.
  3. Group application by institute:
    The institute can make the application on behalf of the students so that their visits to the Immigration Department can be minimized. The procedure is as follows:
    (1) The institute sends an official letter to the respective Subdivision, providing the personal information of the institute representative;
    (2) When making the application, the institute representative is required to:
    A. Present his/her staff card and identity card to the Subdivision for verification;
    B. Bring along the valid passport/travel document or "P.R.C. Permit for Travelling to and from Hong Kong and Macao" (together with "Type D – Stay" endorsement) of the students concerned so that the relevant procedure can be completed when the application is approved;
    C. Sign to acknowledge the notification letter on behalf of the students;
    (3) The institute representative should check the documents in the presence of an immigration staff and ensure to return the travel document and notification letter to the respective student.
    [Note: If the institute adopts the approach of group application to facilitate the students, it should supervise the whole procedure, ensuring that its representative can collect all the documents of the students concerned and submit them to the respective Subdivision, as well as returning the documents to the respective student upon completion of the procedure.]

Remark:I. Time limit for application for "Authorization to Stay - student type" by mainland students
  1. Starting from 8 February 2010, mainland students holding a "P.R.C. Permit for Travelling to and from Hong Kong and Macao" are required to apply for "Authorization to Stay - student type" as soon as they enter Macao with "Type D – Stay" endorsement and within the limit of stay granted upon their first entry (a maximum of 90 days). If they do not apply within the above period but can present proof of study at a higher institute in Macao (e.g. valid student card, school testimonial, etc.), they will be admissible upon re-entry and will be given a written notification of the date to go to the Immigration Department for the relevant procedure. However, if they are not able to present any proof, they may be refused entry to Macao.
  2. Mainland students who entered Macao with "Type D – Stay" endorsement before 8 February 2010 but have not applied for (or completed the application procedure of) "Authorization to Stay - student type" are also required to go through the relevant procedure at the Immigration Department within the limit of stay granted upon entry or on the date specified in the notification letter.
    [Note: Students who do not apply to the Foreigners Subdivision within their limit of stay or on the date specified in the notification letter issued at the border checkpoint will be considered to be overstayers and liable to penalty.]
II. Expiry of "Slip of Authorization to Stay - student type"
  1. For program of studies that lasts for less than a year:
    The "Slip of Authorization to Stay - student type" will expire on the last day of the program
  2. For program of studies that lasts for more than a year until a date before December 31 of the following year:
    The "Slip of Authorization to Stay - student type" will expire on the last day of the program
  3. For program of studies that lasts for more than a year until a date after December 31 of the following year:
    The "Slip of Authorization to Stay - student type" will expire on December 31 of the following year [Application for renewal is required. For details, please see the Renewal Section of "Special Authorization to Stay" (for Non-resident Students)]
    [Note:
    (1) The expiry date of the above "Authorization to Stay - student type" should not exceed that of the "P.R.C. Permit for Travelling to and from Hong Kong and Macao" and "Type D – Stay" endorsement of mainland students. For other students, the expiry date of the above "Authorization to Stay - student type" is restricted to 30 days before the expiry of their passport/travel document and entry/return permit (Article 9 of Administrative Regulation No. 5/2003).
    (2) Students whose passport / travel document or "P.R.C. Permit for Travelling to and from Hong Kong and Macao" (together with the "Type D – Stay" endorsement) expires earlier and so are not granted "Authorization to Stay - student type" that expires as mentioned above are required to submit copies of the relevant documents to the Foreigners Subdivision for reposition (i.e. issuing the "Slip of Authorization to Stay - student type" which expires as mentioned above) as soon as they finish renewing the document.]
III. Extension of stay
If a student needs to continue his/her stay in Macao for personal reason after completing the program, he/she may apply for extension of the "Authorization to Stay". [For details, please see the extension section]
 
IV. Multiples entries
  1. Students can enjoy multiple entries before the expiry of the temporary "Authorization to Stay" or "Authorization to Stay - student type" granted by our Department.
    (1) Persons who are exempted from a "visa" or "entry permit" [for details, please see Section VII of "Entry and Departure of Non-residents"] are allowed to stay until the expiry of that "Authorization to Stay" whenever they re-enter Macao, except for persons who are entitled to a longer limit of stay.
    (2) Persons who are not exempted from a "visa" or "entry permit" may enjoy visa-free or entry-permit-free stay until the expiry of that "Authorization to Stay" whenever they re-enter Macao. However, if their intended stay exceeds the expiry of the "Authorization to Stay", they are required to apply for "entry permit" upon re-entry. [For details, please see Point 5, Section VI of "Entry and Departure of Non-residents"]
  2. Mainland students who submit an application for "Authorization to Stay - student type" will have their "P.R.C. Permit for Travelling to and from Hong Kong and Macao" be granted a temporary "Authorization to Stay". Upon approval of their application, "Authorization to Stay - student type" will be granted. These students can enjoy multiple entries until the expiry of that "Authorization to Stay".
V. Reminders to students granted "Authorization to Stay - student type"
  1. Class attendance should meet the institute requirement, or it may result in invalidation of the "Authorization to Stay - student type".
  2. If the student drops out, suspends schooling or finishes his/her studies early, he/she will have to:
    (1) Leave Macao on or before the first government working day following the completion of the school leaving procedure. In case the student needs to extend his/her limit of stay in Macao, he/she should cancel his/her original "Special Authorization to Stay" in person at the Foreigners Subdivision of our Department and apply for ordinary "Authorization to Stay" for the purpose of extension of stay and departure from Macao during office hours on the first government working day following the completion of the school leaving procedure;
    (2) If the student does not apply for "Authorization to Stay" accordingly but just possesses the original "Special Authorization to Stay", he/she will become an ‘overstayer’ starting from the second government working day following our receipt of the formal notification from the higher institute.
    Example 1: Student A completes the school leaving procedure on 4 January 2016 (Monday). He/she should leave Macao on or before 5 January 2016 (Tuesday), or he/she should cancel the original "Special Authorization to Stay" in person at our Foreigners Subdivision and apply for ordinary "Authorization to Stay" during office hours on 5 January 2016 (Tuesday). If student A remains in Macao by simply possessing the original "Special Authorization to Stay", he/she becomes an ‘overstayer’ starting from 6 January 2016 (Wednesday).
    Example 2: Student B completes the school leaving procedure on 8 January 2016 (Friday). He/she should leave Macao on or before 11 January 2016 (Monday), or he/she should cancel the original "Special Authorization to Stay" in person at our Foreigners Subdivision and apply for ordinary "Authorization to Stay" during office hours on 11 January 2016 (Monday). If student B remains in Macao by simply possessing the original "Special Authorization to Stay", he/she becomes an ‘overstayer’ starting from 12 January 2016 (Tuesday).
  3. If the student intends to transfer to another higher institute, he/she should also cancel the "Authorization to Stay - student type" as mentioned above at the Foreigners Subdivision and apply for new "Authorization to Stay - student type" before the expiry of the ordinary "Authorization to Stay" by submitting proof of enrollment for a new program.
  4. If the entry document is lost while the ‘Authorization to Stay’ for non-resident students is still valid, the student should apply for a replacement of the document and then bring the replaced document to the Foreigners Subdivision for update of the document information and reissue of the “Slip of Authorization to Stay”.
VI. Penalty for overstay
  1. According to Administrative Regulation No. 14/2014 'Amendments to the Provision on Overstay in the 《Regulations of the Entry, Stay and Residence Authorization》', persons who still stay in the Macao SAR but not over 30 days after the expiry of the authorization granted is fined MOP500 per overdue day from 9/7/2014. The violators are required to pay the fine immediately after they are arrested or report themselves to the police. The above mentioned penalty regulation is not applicable to those who have overstayed in Macao within one year. Those will be considered to be illegal immigrants if they do not pay the fine and the penalty regulation is not applicable to them. Moreover, they cannot make any application for Residence Authorization, extension of Authorization to Stay and Authorization to Stay for Non-resident Workers within two years to the Immigration Department.
  2. According to Law No. 6/2004, persons who are considered to be illegal immigrants will be deported and interdicted from entry to the Macao SAR for the period indicated in the deportation order.

Non-resident students who need to continue staying in Macao to complete their studies at the higher institute while the original "Authorization to Stay - student type" is expiring (or has expired) (generally on December 31)
 
B. Application Eligibility
  1. Meeting the stipulations relevant to the system of entry, stay and residence authorization in Macao
    (e.g. 1. In possession of a valid passport/travel document/identification document for entry to and departure from Macao;
    and 2. Not in a lawfully restricted status. [Note: For reference, please see 'Remark'])
  2. Still taking the program at the higher institute in Macao
  3. Original "Authorization to Stay - student type" is expiring (or has expired) and so renewal is needed for the student to legally stay in Macao for study.
Application Approach:It is stipulated in the law that annual verification of a student's status before he/she is granted "Authorization to Stay - student type" is necessary if the program lasts for more than a year. Therefore, if the remaining courses of the program last for more than 1 year until a date after December 31 of the following year, students who are not able to have their status verified and be granted renewal of "Authorization to Stay - student type" through the "group application" approach mentioned below are required to apply for renewal by "individual application" approach.
  1. Group application:
    (1) The Immigration Department and the higher institute exchange information to verify the status of the students (the verification procedure for each scholastic year is generally completed by November). The respective Subdivision sends the institute a list of the students who have their application for renewal of "Authorization to Stay - student type" approved immediately after verification of the student status so that the institute can notify them to go to the Foreigners Subdivision for completing the relevant procedure. [Note: In order to prevent themselves from violating the law for overstay, students who are not able to have their status verified through "group application" and complete the procedure before the expiry of the original "Authorization to Stay - student type", and students who are not listed for verified status for specific reasons are required to go through the application procedure of renewal of "Authorization to Stay - student type" at the Foreigners Subdivision through "individual application". For reference, please see Point V in "Remark".]
    (2) Generally, if a student's "Authorization to Stay - student type" for the current scholastic year expires before December 31 because his/her passport/travel document or "P.R.C. Permit for Travelling to and from Hong Kong and Macao" (together with the "Type D – Stay" endorsement) expires earlier in the previous scholastic year, he/she should submit copies of the relevant documents to the Foreigners Subdivision as soon as they finish renewing the document, provided that he/she continues the program of study during the standard period at the higher institute. By doing so, the student can apply for reposition immediately ("Authorization to Stay - student type" will be valid until December 31 of the current scholastic year). In this way, he/she can stay legally in Macao while waiting for the institute's notification of the approval of his/her application for renewal of "Authorization to Stay - student type".
  2. Individual application:
    Students should make the application in person 20 days before the expiry of the "Authorization to Stay - student type" (generally on December 31).

Students who have their group application for renewal of "Authorization to Stay - student type" approved are required to bring along A copy of their passport / travel document (bio data page and used inside pages only) or A copy of P.R.C. Permit for Travelling to and from Hong Kong and Macao and "Type D – Stay" endorsement (bio data page and inside pages with exit-entry stamps and the "endorsement" for book style "P.R.C. Permit for Travelling to and from Hong Kong and Macao" users) and submit a copy of the last "Slip of Authorization to Stay - student type" issued by our Department to the Foreigners Subdivision for relevant procedure on the date notified by the higher institute. For inquiry of the progress of the application, they may refer to 'Inquiry System of Progress of Application for "Special Authorization to Stay" for Non-resident Students' on our website. They can come to our Department to complete the procedure when the result is out.
  2. The higher institute can complete this procedure on behalf of the students.

If the student intends to transfer to another higher institute, he/she should also cancel the "Authorization to Stay - student type" as mentioned above at the Foreigners Subdivision and apply for new "Authorization to Stay - student type" before the expiry of the ordinary "Authorization to Stay" by submitting proof of enrollment for a new program.
  4. If the entry document is lost while the ‘Authorization to Stay’ for non-resident students is still valid, the student should apply for a replacement of the document and then bring the replaced document to the Foreigners Subdivision for update of the document information and reissue of the “Slip of Authorization to Stay”.
V. Penalty for overstay
  1. According to Administrative Regulation No. 14/2014 'Amendments to the Provision on Overstay in the 《Regulations of the Entry, Stay and Residence Authorization》', persons who still stay in the Macao SAR but not over 30 days after the expiry of the authorization granted is fined MOP500 per overdue day from 9/7/2014. The violators are required to pay the fine immediately after they are arrested or report themselves to the police. The above mentioned penalty regulation is not applicable to those who have overstayed in Macao within one year. Those will be considered to be illegal immigrants if they do not pay the fine and the penalty regulation is not applicable to them. Moreover, they cannot make any application for Residence Authorization, extension of Authorization to Stay and Authorization to Stay for Non-resident Workers within two years to the Immigration Department.
  2. According to Law No. 6/2004, persons who are considered to be illegal immigrants will be deported and interdicted from entry to the Macao SAR for the period indicated in the deportation order.

Target Groups and Application Eligibility:Non-resident students who drop out, suspend schooling, finish studies early, transfer to another higher institute or discontinue studies at the original higher institute for other reasons before the expiry of the "Authorization to Stay - student type"

[Note: Upon completion of the drop-out or suspension procedure, the higher institute will notify the Immigration Department accordingly. As soon as our Department receives the notification letter, the student's "Authorization to Stay - student type" becomes invalid immediately (even though it is not expiring). If the student fails to cancel the "Authorization to Stay - student type" and apply for ordinary "Authorization to Stay" for departure preparation in person within the time limit, overstay will result from the invalidation of the "Authorization to Stay - student type" under the circumstance that the student has no other valid "Authorization to Stay" (e.g. Authorization granted upon entry) (For details, please see "Remark").]

    [Note: Upon completion of the procedure, the student's "Authorization to Stay - student type" will be cancelled. If the student does not possess other valid "Authorization to Stay" but meets the stipulations relevant to the system of entry, stay and residence authorization in Macao [i.e. 1. his/her passport/travel document / "Type D – Stay" endorsement in the P.R.C.   1. If the student drops out, suspends schooling or finishes his/her studies early, he/she will have to:
    (1) Leave Macao on or before the first government working day following the completion of the school leaving procedure. In case the student needs to extend his/her limit of stay in Macao, he/she should cancel his/her original "Special Authorization to Stay" in person at the Foreigners Subdivision of our Department and apply for ordinary "Authorization to Stay" for the purpose of extension of stay and departure from Macao during office hours on the first government working day following the completion of the school leaving procedure;
    (2) If the student does not apply for "Authorization to Stay" accordingly but just possesses the original "Special Authorization to Stay", he/she will become an ‘overstayer’ starting from the second government working day following our receipt of the formal notification from the higher institute.
    Example 1: Student A completes the school leaving procedure on 4 January 2016 (Monday). He/she should leave Macao on or before 5 January 2016 (Tuesday), or he/she should cancel the original "Special Authorization to Stay" in person at our Foreigners Subdivision and apply for ordinary "Authorization to Stay" during office hours on 5 January 2016 (Tuesday). If student A remains in Macao by simply possessing the original "Special Authorization to Stay", he/she becomes an ‘overstayer’ starting from 6 January 2016 (Wednesday).
    Example 2: Student B completes the school leaving procedure on 8 January 2016 (Friday). He/she should leave Macao on or before 11 January 2016 (Monday), or he/she should cancel the original "Special Authorization to Stay" in person at our Foreigners Subdivision and apply for ordinary "Authorization to Stay" during office hours on 11 January 2016 (Monday). If student B remains in Macao by simply possessing the original "Special Authorization to Stay", he/she becomes an ‘overstayer’ starting from 12 January 2016 (Tuesday).
  2. If the student intends to transfer to another higher institute, he/she should also cancel the "Authorization to Stay - student type" as mentioned above at the Foreigners Subdivision and apply for new "Authorization to Stay - student type" before the expiry of the ordinary "Authorization to Stay" by submitting proof of enrollment for a new program.
